Larceny, sometimes referred to under other state law as
simple larceny or grand larceny, is a theft. A
larcency can occur by trespass or delivery. If the perpetrator trespasses
upon the property of another person and then takes and carries away property
without permission and with intent to permanently deprive the owner of
that property, a larceny has been committed.
A larceny can also be committed by delivery of the property.
If the property owner willingly delivers the property to a person who
later decides to take the property and convert it into his own use, a
larceny is committed when the property is converted.
Larceny is very similar to embezzlement,
except that an embezzler is usually employed by the property owner. In
a larceny, the person who steals the property has constructive custody
of the property, a custody which was granted by the property owner. Because
of the later misappropriation of the property from a mere keeping custody
of the property to a personal use including selling, concealing, or otherwise
disposing of the property, the otherwise legal holding of the property
because an illegal conversion.
