Wisconsin's foremost authority on drunk driving laws and defenses, Attorney Tracey Wood, has written the book on challenging prior drunk driving convictions, and both her and Attorney Christopher Van Wagner represent people who have been arrested and charged with a drunk driving offense in Jefferson, Wisconsin and thorughout Jefferson County.

WI OWI - DUI - DWI - OMVWI

The terms used for drunk driving violations in Wisconsin include OWI for Operating While Intoxicated, DUI for Driving Under the Influence, DWI for Driving While Intoxicated, and OMVWI for Operating a Motor Vehicle While Under the Influence.

Regardless of the term, a drunk driving offense in Wisconsin alleges that the driver of a motorized vehicle was under the influence while driving or being in a position in which driving could easily occur (such as asleep behind the wheel of a parked car). The agent causing the person to be "under the influence" can be any alcohol or drug that impairs driving including prescription drugs.

Potential drunk driving Charges, Sentences & Fines

People who have been arrested for a drunk driving office can receive two tickets. The first ticket is for an OWI - operating a motor vehicle while under the influence. The second ticket, if you receive a second ticket, will likely be for violating Wisconsin's prohibited alcohol content level laws (the PAC ticket).

Actual drunk driving charges depend on several factors, such as if the person had previously been convicted of a drunk driving offense in this or any other state, had refused to submit to a sobriety test, and the number of prior convictions or refusals. Penalties for a drunk driving conviction increase as the number of convictions (or refusals) increases.

Wisconsin's Foremost Authority on Drunk Driving Laws

Attorney Tracey A. Wood frequently represents people who have been arrested and charged with a drunk driving offense in Jefferson, Wisconsin and throughout Jefferson County.

While the majority of charges brought by a district attorney in Jefferson County will be for an OWI - operating while under the influence, police officers may also arrest people for (and the DA bring charges for) refusing to submit to a sobriety test, operating a motorized vehicle after revocation, operating a motorized vehicle during driver's license suspension, and vehicular homicide or injury by intoxicated use of a motor vehicle.

Legal Limits

The legal limit of alcohol in a person's bloodstream is directly related to their age, the number of prior convictions (or test refusals), and their occupation.

A person who has never been stopped for suspicion of driving while under the influence is prohibited from driving with a .08 BAC (blood alcohol content level). Refusals count as prior convictions.

A person who has previously been convicted of drunk driving (or refusing to submit to an alcohol test to determine drunkenness) is prohibited from driving with a .02 BAC (blood alcohol level).

Minors are prohibited from driving with any trace of alcohol in their system. For more information about minors and driving, please refer to zero tolerance.
